Agreement to Terms
By accessing and using SchoolMS ("the Service"), you agree to be bound by these Terms of Service.
If you do not agree to these terms, please do not use our Service.
Service Description
SchoolMS provides a comprehensive school management platform that includes student information systems,
fee collection, attendance tracking, grade management, parent portals, and related educational technology services.
User Accounts
Account Creation
- Schools must provide accurate and complete information during registration
- You are responsible for maintaining the confidentiality of your account credentials
- You must notify us immediately of any unauthorized access to your account
- One account per school; multiple users can be added within the account
Account Responsibilities
- You are responsible for all activities under your account
- You must ensure all users comply with these Terms
- You must not share login credentials across multiple individuals
Acceptable Use
You agree NOT to:
- Use the Service for any illegal purposes
- Violate any applicable laws or regulations
- Infringe on intellectual property rights
- Upload malicious code or viruses
- Attempt to gain unauthorized access to our systems
- Interfere with or disrupt the Service
- Use the Service to harass, abuse, or harm others
- Resell or redistribute the Service without permission
Payment Terms
Subscription Fees
- Fees are billed monthly or annually based on your chosen plan
- All fees are in Kenya Shillings (KES) unless otherwise stated
- Prices are subject to change with 30 days' notice
- Payments are non-refundable except as required by law
Payment Methods
We accept M-Pesa, bank transfers, credit cards (via Stripe), and other payment methods as available.
Data Ownership and Usage
- You retain ownership of all data you input into the Service
- We have the right to use aggregated, anonymized data for analytics and improvements
- You grant us a license to host, store, and process your data to provide the Service
- You can export your data at any time
Service Availability
- We strive for 99.9% uptime but do not guarantee uninterrupted service
- Scheduled maintenance will be announced in advance when possible
- We are not liable for service interruptions beyond our control
Intellectual Property
All content, features, and functionality of SchoolMS are owned by us and protected by international
copyright, trademark, and other intellectual property laws. You may not copy, modify, or reverse
engineer any part of our Service.
Termination
By You
You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.
By Us
We may suspend or terminate your account if you violate these Terms, fail to pay fees, or for any
reason with 30 days' notice.
Limitation of Liability
To the maximum extent permitted by law, SchoolMS shall not be liable for any indirect, incidental,
special, consequential, or punitive damages, including loss of data, revenue, or profits.
Indemnification
You agree to indemnify and hold harmless SchoolMS from any claims, damages, or expenses arising from
your use of the Service or violation of these Terms.
Governing Law
These Terms are governed by the laws of Kenya. Any disputes shall be resolved in the courts of Nairobi, Kenya.
Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of significant changes.
Continued use of the Service after changes constitutes acceptance.
